These Membership Terms govern the membership relationship between users who create a membership on the GYMSS website and GYMSS, and the basic principles for using the website.
By creating a membership on our website, you are deemed to have accepted these terms.
1. Scope of the Service
GYMSS offers competition, training and custom-designed sportswear for performance athletes, especially in gymnastics disciplines.
Our website serves to present our products, provide access to product catalogues and receive our customers' quote requests.
No direct online sales are made on the website and the sales prices of the products are not published.
Members can request quotes for the products they are interested in and can view or download the product catalogues made available.
2. Membership and User Responsibilities
The information given when creating a membership must be accurate, up to date and complete.
Individual membership is open only to persons who have reached the age of 18. Transactions concerning athletes under the age of 18 may be carried out by their parents or legal representatives.
Persons who create a membership on behalf of a club, federation, sports organisation or company declare that they are authorised to act on behalf of that organisation.
Members are obliged to take due care to keep the passwords of their accounts confidential and to prevent their account information from being used by unauthorised persons.
If it is thought that the security of the account has been compromised, the password must be changed and GYMSS must be informed.
GYMSS reserves the right to apply the necessary technical and administrative measures to ensure the security of membership accounts.
3. Quote and Order Processes
Quote requests sent through the GYMSS website do not by themselves constitute a binding order or purchase commitment.
In line with the customer's request, a price quote may be prepared by evaluating the product features, quantity, design preferences and other needs.
The quote prepared is sent to the customer electronically.
The quote may include information such as product details, price, payment terms, production time, delivery terms and the validity period of the quote.
After the customer accepts the quote, the order becomes final upon completion of the order and contract terms presented to the parties.
In consumer transactions, the pre-contractual information and contract obligations required under the related legislation are fulfilled separately.
4. Custom-Designed and Personalised Products
In addition to its standard products, GYMSS may prepare custom-designed and personalised products for clubs, federations, teams and individual athletes.
For these products, the size, colour, fabric, design, name, logo or other personalisation options may be determined in line with the customer's requests.
The technical specifications, design approvals, production times, payment and delivery terms of custom production are set out separately in the related quote or order documents.
For products prepared in line with the consumer's wishes or personal needs, the exceptions to the right of withdrawal set out in the related legislation may apply.
The scope of these exceptions and the consumer's legal rights are notified separately before the order, in accordance with the related legislation.
5. Intellectual Property Rights
The trademarks, logos, product images, designs, photographs, drawings, texts and other content on the GYMSS website and in the product catalogues belong to GYMSS or the relevant right holders, unless stated otherwise.
This content may not be copied, reproduced, distributed or used for commercial purposes without the prior written permission of the right holder.
The owner of the relevant rights, or the person authorised to use them, is responsible for obtaining the permissions required for the use of trademarks, logos, images or designs belonging to third parties that the customer sends to GYMSS.
GYMSS's rights in its own designs are reserved unless otherwise agreed in writing between the parties.
6. Suspension and Termination of Membership
Members may request the termination of their membership by contacting GYMSS.
GYMSS may suspend or terminate a membership if it detects conduct contrary to the membership terms, the provision of untrue information, unauthorised use or activities that threaten system security.
The termination of the membership does not remove the rights and obligations arising from contracts previously concluded.
Personal data relating to the membership is kept or deleted in accordance with the conditions set out in KVKK and the related legislation.
7. Updates to the Terms
GYMSS may update the membership terms in line with changes in legislation, security requirements or developments in service processes.
Updated terms are published on the website. For material changes affecting the rights and obligations of existing members, additional information is provided where necessary and the legally required consents are obtained.
8. Applicable Law and Disputes
Turkish law applies to the interpretation and application of these membership terms.
For disputes that may arise from the membership and GYMSS services, the competent courts and other legal authorities under the related legislation apply.
The rights of consumers arising from the Turkish Consumer Protection Law No. 6502 and the related legislation are reserved.
